A Medicare set-aside trust or custodial account satisfies the Medicare secondary-payer statute in a way that protects both claimants and insurers – by setting aside a portion of a settlement to privately pay for injury-related medical bills that Medicare would otherwise be required to pay. When these funds are exhausted, Medicare resumes payment.

The Protocols® Medicare set-aside analysis and allocation service combines an in-depth review and analysis of a claimant’s medical records and medical payment history with a projection of future medical costs. These numbers are used to project future costs and calculate the amount of the medical portion of a proposed settlement – and any allocation that must be submitted to the Centers for Medicare and Medicaid Services.
