What is involved in Protocols® medical settlement planning?
In order to provide optimal outcomes for all parties, Protocols® medical settlement planning teams:
- Evaluate medical cost projections;
- Evaluate relative settlement positions of parties;
- Project future medical costs;
- Determine and negotiate Medicaid lien and Medicare subrogation rights;
- Prepare and submit Medicare set-aside allocation proposals to the Centers for Medicare & Medicaid Services;
- Negotiate approval of Medicare set-aside allocations before CMS;
- Establish and administer both medical and Medicare set-aside accounts; and
- Consult with claimants regarding self-administration of Medicare set-aside accounts.

Protocols® got its start as part of a law firm – Sagrillo Hammond & Dineen, LLC – a Denver-based firm with a national reputation for handling complex settlement matters, including Medicare set-aside analysis and allocations, Medicare secondary-payer issues and special needs trusts. Protocols® and SHD continue to work hand-in-hand, when necessary, to provide clients with a full range of services – consultative as well as legal.
