Legislation Introduced to Streamline MSA Process

Legislation was recently introduced to create new standards regarding Medicare Set-Asides.  H.R. 2549, sponsored by Rep. John Tanner (D-TN), Rep. Phil English (R-PA), Rep. Thomas M. Reynolds (R-NY), and Rep. Chris Van Hollen (D-MD), was introduced in the House on May 24, 2007.  The bill aims to create consistent standards and achieve a more efficient review process that currently poses a burden on injured workers as well as states and workers’ compensation payers.

Review of CMS Medicare Set-Aside Review Thresholds

Most of us in the workers’ compensation industry are familiar with the CMS Medicare set-aside review thresholds for workers’ compensation claims. However, there is still some confusion – especially for third-party liability cases – about the applicability of the thresholds.  The following guidelines explain the thresholds, both for workers’ compensation settlements and in third-party liability settlements.

Would Your Medicare Set-Aside Compliance Program Stand Up to Scrutiny?

Even with the best Medicare set-aside compliance programs, some workers’ compensation cases since July 2001 will have been settled without consideration of Medicare’s interests. Having an established, documented program can only serve to demonstrate to CMS that any cases missed were inadvertent and did not demonstrate a pattern of ignorance or non-compliance with the Medicare Secondary Payer regulations. A review of an existing Medicare set-aside program would enhance a current program as well as provide training opportunities for staff.
