CMS recently announced that it will implement a value-based purchasing method to calculate reimbursement rates for physicians. The program will target specific physicians in 2015, but the program is expected to expand to all physicians by 2017. Under the program, physicians’ reimbursement rates will be affected by the quality of care furnished in relation to cost.

Liability Medicare Set Aside arrangements (LMSA) have been the subject of debate between plaintiffs’ attorneys and the insurance industry. Until recently, CMS had not published any specific guidelines regarding the use of MSAs in non-workers compensation cases. This changed on September 30, 2011 when CMS issued its first Memo regarding proposed Liability Medicare Set-Aside Arrangements.
